Regulators Cut Red Tape- 16/05/2008
Seven principles of regulation will make life easier for businesses in Shropshire, a compliance expert predicts.
David Campbell, solicitor from FBC Manby Bowdler LLP, welcomes the new Regulators’ Compliance Code.
He says: “Many local businesses will have been inspected, investigated or possibly even prosecuted by regulatory bodies such as the Health & Safety Executive, local council, fire authority or the Environment Agency.
“The new code should simplify things for businesses as it will help ensure that regulators are as effective and efficient as possible. Regulatory bodies have to follow the code in their work and when formulating their enforcement policies.”
In 2005 the Government commissioned Philip Hampton, chairman of J Sainsbury plc, to investigate how businesses could reduce unnecessary administration without the effectiveness of the regulatory regime being compromised.
The findings of the report recommended seven principles that form the basis of the new Regulators’ Compliance Code:
- Regulators should recognise they exist to allow and encourage economic progress so should intervene only where there is a clear case for prosecution.
- They should employ comprehensive risk assessment to concentrate their resources in the areas they are most needed.
- Regulators should provide accessible, authoritative advice that is available easily and cheaply.
- There should always be a reason for an inspection.
- Businesses should not have to give unnecessary information or give the same information twice.
- Businesses that persistently break regulations should be identified quickly and face proportionate and meaningful sanctions.
- Regulators should be accountable for the efficiency and effectiveness of their activities while remaining independent in the decisions that they take.
Mr Campbell concludes: “If a business is being inspected or investigated by regulators they should seek professional advice and assistance.”
