Licensing Curbs Extended to Wolverhampton Takeaways- 11/05/2010

Takeaway food establishments which want to open or extend their operating hours within Wolverhampton City Centre Ring Road can now have their licence refused unless they can prove they will not add to late night disorder, according to a leading Wolverhampton licensing lawyer.

“This move brings takeaways into line with pubs, clubs and restaurants operating in the same area,” says David Campbell, an Associate in the Licensing Department at Wolverhampton law firm FBC Manby Bowdler LLP.

“Any operator applying for a licence to open such an establishment or for an amendment to an existing licence to increase their trading hours may find that their application is blocked, unless they show what measures they are taking so that they do not add to the problems of night-time trouble which the Police say are occurring within the Ring Road.”

“There is already a general presumption that for premises where alcohol is sold, that applications for longer hours will generally be refused.

“While these moves may help weed out irresponsible operators and reduce late night disorder on the streets of Wolverhampton, responsible establishments will now find it harder to gain or extend licences, and they will certainly need specialist legal help to make applications,” concludes Mr Campbell.

Through its specialist Wolverhampton-based Licensing Department, FBC Manby Bowdler advises on all manner of licensing and regulatory matters.
