Unfair Dismissal & Employer's Ability to Pay- 01/10/2010

In the case of Tao Herbs and Acupuncture Limited v Jin the employer was ordered to pay compensation of over £9,000 for unfair dismissal. The employer argued that if they had to pay out such an amount then it could force the business to fold. The EAT ruled that considering the employers’ financial status and inability to pay is not a factor to take into account in determining how much the employer has to pay to the employee who has been unfairly dismissed.
