Failure to identify driver
If the driver of a vehicle is suspected to have committed an offence (typically speeding) then the Police will ask the registered keeper to identify who was driving at the time of the offence. They may also ask other people to provide information. This is with a view to possibly prosecuting the actual driver or giving them a fixed 3 point penalty. If you fail to identify who was driving then it will be you who is punished.
There are certain procedural requirements that the Police have to adhere to in order to make a valid request of you to identify the driver. It is important that you give all required information within the time limits provided so that you do not fall foul of the law. There are defences but it is up to you to prove them. If you are a Company the obligations are more onerous. A conviction for failing to comply leads to 6 points and a fine/ costs.
