FBC Manby Bowdler has secured a victory in the High Court on behalf of a toddler who suffered catastrophic injuries after falling from a first floor window.
Sue Todhunter, Partner with the firm’s Serious Injury Team, advised the father of the child who made a claim for damages against a local council.
The Judge found that a workman who had carried out repair work to the window shortly before the child’s fall was negligent. The council had steadfastly denied that the workman had left the window unlocked.
Mr Record Sephton QC, sitting at Manchester District Registry, ordered the council to pay the legal costs of bringing the claim.
There will be a further hearing to decide the level of damages at a later date.
