More turning to legal powers during pandemic, says legal expert

The Covid pandemic has led to a growing number of people turning to a special legal measure to help them ensure their affairs are in order, a Redditch legal expert said today.

Sara Simson, of award-winning law firm FBC Manby Bowdler, says there has been a sharp rise in the number of people inquiring about Lasting Powers of Attorney (LPA) since March.

LPAs allow a person to appoint someone they know to act on their behalf should they lose the ability to make decisions for themselves and can cover issues such as money, property and health.

Sara, an associate with the law firm’s wills, probate and lifetime planning team, said up to 90 per cent of clients making wills in recent months had also included an LPA as part of their planning.

“There has been a sharp increase in the number of LPAs being signed over the past five years generally, but we have seen this accelerate in the light of the pandemic,” she said.

“As many as 90 per cent of people coming in to make a will are now also making an LPA because of the extra level of reassurance and protection it offers. And whilst LPAs might formerly have been reserved for the elderly, we are now seeing much younger clients making use of them.

“The Covid-19 pandemic has certainly focussed people’s minds on making sure they have their affairs in order and that their assets are protected, because we have all seen how quickly life can change for any of us.”

Sara said there had never been a more important time to make sure you had a will and that you had your affairs in order.

“This is all about taking the sensible step of planning for your future and making sure that your assets go where you want them to go and that your affairs are put in the hands of people you trust should you be incapacitated at any time.

“It is the sort of sensible life planning we would recommend to anyone and is straightforward and easy to put in place with proper legal advice.”

Latest figures show the number of people using a Lasting Power of Attorney has soared by more than 180 per cent in the last five years.
